Know Your Options

The Drug Education Program, or “DEP,” is a program for defendants charged with Possession of Narcotics, Possession of Drug Paraphernalia, and Possession of certain quantities of Marijuana. Defendants charged with Sale, or Possession With Intent to Sell, are only able to use DEP if the prosecutor is convinced to lower the charges.

If DEP is granted, the defendant will be required to abide by all court orders, complete community service, and attend either drug education classes or substance abuse treatment. If the defendant is successful, the charges will be dismissed. Some defendants may be able to use DEP multiple times.

The Drug Education Program is not guaranteed. If a judge denies an DEP application, the State’s Attorney will likely prosecute the defendant. If the program is denied there is a greater chance that the case will result in a criminal record, incarceration, and in some cases, felony conviction.
